کرناٹک ہائی کورٹ نے پیر کے روز ریاستی حکومت کے اس حکم پر وزراء اور منتخب نمائندوں کے خلاف 61 الزامات ختم کرنے پر روک دی۔
چیف جسٹس ابے شرینیواس اوکا اور جسٹس وشواجیت شیٹی پر مشتمل ڈویژن بینچ نے حکم دیا ، “ہم ہدایت کرتے ہیں کہ 31 اگست 2020 کے حکم کی بنیاد پر مزید اقدامات نہیں اٹھائے جائیں گے۔”
عدالت نے حکومت کو آئندہ سال 22 جنوری تک اپنا اعتراض داخل کرنے کا حکم دیا۔
یہ حکم ایک غیر سرکاری تنظیم ، پیپل یونین آف سول لبرٹیز کی جانب سے دائر درخواست کی بنیاد پر کیا گیا تھا ، جس نے فوجداری ضابطہ اخلاق کی دفعہ 321 کے تحت 61 مقدمات کی کارروائی واپس لینے کے حکومتی فیصلے کو چیلنج کیا تھا۔
یکم دسمبر کو کیس کی سابقہ سماعت کے دوران ، ہائی کورٹ نے اپیکس عدالت کے ایک حکم کا حوالہ دیا۔
اس میں یہ بھی کہا گیا ہے کہ اگر حکومت سرکاری وکیل کو کسی مقدمے کی کارروائی سے دستبردار ہونے کی ہدایت کرتی ہے تو بھی ، اس معاملے کے حقائق پر اپنا ذہن اپنانے کے بعد یا تو ہدایات سے متفق ہوسکتی ہے اور عدالت کے روبرو دستبرداری کی بنیاد بتاتے ہوئے پٹیشن دائر کرسکتی ہے یا استغاثہ کے لئے اچھ caseا مقدمہ ڈھونڈنے اور دستبرداری کی درخواست دائر کرنے سے انکار کرنے سے اتفاق کریں۔
“یہ بھی مشاہدہ کیا گیا ہے کہ اگر سرکاری وکیل نے اس سے اتفاق نہیں کیا تو ، اسے مختصر واپس کرنا پڑے گا۔
مزید مشاہدہ کیا گیا ہے کہ پبلک پراسیکیوٹر پوسٹ بکس کی طرح کام نہیں کرسکتا ہے یا ریاستی حکومت کے حکم پر عمل نہیں کرسکتا ہے اور اسے معروضی کے ساتھ کام کرنا پڑتا ہے کیونکہ وہ عدالت کا افسر بھی ہے۔
اس میں مزید کہا گیا ہے کہ سی آر پی سی کی دفعہ 321 کے تحت کارروائی صرف عدالت کی اجازت سے کی جاسکتی ہے۔
“کوئی بھی عدالت استغاثہ سے دستبرداری کے فیصلے کی پابند نہیں ہے۔
عدالت نے مشاہدہ کیا تھا کہ اگر سی آر پی سی کی دفعہ 321 کے تحت درخواست دی جاتی ہے تو بھی عدالتوں کا فرض ہے کہ وہ اس بات کا جائزہ لیں کہ آیا پہلا مقدمہ پیش کیا گیا ہے یا نہیں اور عدالت دعویٰ مسترد کرنے کا اختیار رکھتی ہے۔
